Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. Sweepstakes is void where prohibited. By entering, each entrant accepts and agrees to be bound by these Official Rules.       

1. SPONSOR:  This Sweepstakes is sponsored by ‘WBND, ABC 57’ (“Sponsor”) whose address is 26 N. Halsted, Chicago, Illinois 60661.

2. ENTRY AND SELECTION OF WINNERS.  A purchase is not required to enter or win the Sweepstakes, and a purchase does not increase the odds of winning. The Sweepstakes begins Sunday, April 22, 2018 at 11:00 PM ET and ends Saturday, April 28, 2018 at 10:59 PM ET unless extended by ‘WBND, ABC 57.’ To participate, viewers must watch ABC 57 News at 11:00 PM ET on ABC 57 for their chance to win a trip for two (2) to the American Idol taping on Sunday, May 13, 2018 in Los Angeles, CA (“Prize”) during the Sweepstakes period on ‘WBND, ABC 57.’ Each night during the ABC 57 News broadcast at 11:00 PM on ABC 57, a Code Word of the Day will be shown. Each broadcast of the Code Word is a distinct chance to win. Viewers who miss the original broadcast of the Code Word can listen to U93 (92.9 FM) the following morning during the 6:00 AM ET hour for a second chance to hear the previous evening’s Code Word. Persons wishing to enter the Sweepstakes must submit the correct Code Word of the Day at www.ABC57.com. Only one (1) entry per person, per email address, per Code Word, per day will be accepted during this Sweepstakes. The entry deadline for each Code Word is at 10:59 PM ET the following day. One (1) Winner will be selected at random from all online entries using a computer software winner selection tool.

Sponsor is not responsible for lost, late, illegible, misdirected or mutilated entries, due to technical/network failures, human error, or any other error or malfunction. Entry materials that have been tampered with or altered are void.

Entrants agree not to upload, post or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Any attempt to deliberately damage any website or undermine the operation of the Sweepstakes is a violation of criminal and civil laws, and Sponsor reserves the rights to seek damages from any person who makes such attempt(s).

Any questions regarding the number of entries submitted by an individual or authorized account holder of an e-mail address shall be determined by ‘WBND, ABC 57’ in its sole discretion, and ‘WBND, ABC 57’ reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes.

3. ELIGIBILITY. The Sweepstakes is open to all legal residents of the South Bend-Elkhart DMA, as defined by Nielsen, and are age 18 years or older. Employees of ‘WBND, ABC 57,’ Weigel Broadcasting Co., Artistic Media Partners, their advertising agencies, consultants, franchisees, suppliers, (collectively, “Sweepstakes Parties”), family members are not eligible to enter or win. In addition, individuals who share a common household with an employee of a Sweepstakes Party or who are in any kind of domestic relationship or partnership with an employee of a Sweepstakes Party (e.g., boyfriends, girlfriends, fiancé, roommates) are not eligible to enter or win this Sweepstakes. Sponsor shall be the sole judge of what constitutes a domestic relationship or partnership in the event of a dispute.

This Sweepstakes is void where prohibited by law. Entrants do not have to have viewed the 11:00 PM broadcast of ABC 57 News to enter for their chance to win this Sweepstakes; however, their entries must include the correct Code Word of the Day.

4. PRIZE. There will be one (1) prize (“Prize”) awarded to Winner (“Winner”). Prize will consist of a trip to Los Angeles, CA for Winner and one (1) guest (“Guest”) to the May 13 American Idol taping (“Trip”). Trip includes: two (2) tickets to American Idol taping on Sunday, May 13, 2018 (“Event”); double occupancy hotel accommodations for two (2) nights (one room, room rate and taxes only); and escorted group transportation to and from the American Idol taping from the hotel; and funds in the amount of one hundred dollars ($100) for expenses and ground transportation; and funds in the amount of five hundred dollars ($500) for travel expenses, total estimated retail value (“ERV”) of $1410. Actual Retail Value (“ARV”) of Prize may vary. Any difference between stated ERV and ARV will not be awarded. Odds of winning will be determined by the total number of eligible Sweepstakes entries containing correct Code Word of the Day submissions. The Winner will be selected and notified on Monday, April 30, 2018 by phone to the phone number listed by entrant on their original Sweepstakes submission. If the selected Winner cannot be reached by phone, an email will be sent to the Winner’s email address listed on their original entry form. The Prize Winner must possess a valid picture ID to claim their Prize.

5. PRIZE RESTRICTIONS AND CONDITIONS. The Prize is non-transferable and must be claimed by the Winner. There will be no substitute or cash redemption awarded to any Sweepstakes Winner. All income and other taxes are the responsibility of the Winner. By entering, the Winner is consenting to the use of their name, likeness, and/or biographical information for advertising and promotional purposes without additional consideration.

The Winner’s travel companion must be at least eight (8) years old. The Winner and their travel companion will check in to the hotel in Los Angeles, CA on Saturday, May 12, 2018 and check out on Monday, May 14, 2018. The Winner will receive a $500 gift card to use towards their travel expenses, and the Winner is responsible for booking their own travel.

In the event production of American Idol is cancelled or postponed, this Prize component may be cancelled without substitution or compensation therefor. All other Prize elements will still be awarded. American Idol tickets have no retail value. 

6. DISCLAIMER OF LIABILITY. By entering this Sweepstakes, each entrant forever discharges, releases, and holds harmless Sponsor and each of its parent companies, subsidiaries, affiliates, and each of its directors, officers, employees, and agents including AIP, FremantleMedia North America, Inc., American Broadcasting Companies, Inc., Impact Marketing & Promotions, Inc., NEG Operations Inc., and all majority owned subsidiaries (including, but not limited to, 19 Entertainment Limited, 19 Entertainment, Inc., 19 Touring LLC, 19 Recordings Limited and 19 TV Limited), Telescope, Inc. and each of their respective parent, subsidiary, affiliated and related entities, and the officers, directors, employees, agents, representatives, licensees and assignees of each.  from any and all liability, claims, losses, damages, causes of action, suits, and demands of any kind arising from or in connection with the Sweepstakes, however caused.

All travel and lodging will be at the risk of Winner and Guest. Winner is solely responsible for all expenses and costs associated with acceptance and/or use of Prize not specifically stated herein as being awarded, including, without limitation any and all taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize, travel insurance, ground transportation (other than as described above), security and airport fees, taxes, insurance, gasoline, meals, gratuities, and souvenirs. Sponsor shall have the right, but not the obligation, to make any deductions and withholdings that Sponsor seems necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances.

The Winner will be solely responsible for any and all local, state, and federal taxes. Sponsor will report any individual winnings more than $600 (in cash or fair market value of the goods or services) in a one-year period to the Internal Revenue Service. The Winner will receive a Form 1099 from Sponsor if Sponsor reports any winnings to the Internal Revenue Service.

The Winner will be required to acknowledge, sign and return an Affidavit of Eligibility, Release of Liability and Letter of Indemnification prior to the receipt of their Prize (except where prohibited). Failure to comply with the rules and conditions of the Sweepstakes may result in a forfeiture of their Prize. The Winner has three (3) business days to return all requested identification and release forms. After this time period, the Prize may be revoked and a new Winner may be drawn from all eligible entries containing correct Code Word of the Day.

7. SPONSOR’S RESERVATION OF RIGHTS.  These Official Rules are subject to modifications by ‘WBND, ABC 57.’ The decisions made by ‘WBND, ABC 57’ concerning any and all matters with respect to this promotion shall be final. In the event of a computer or telephone failure, or any other circumstances beyond the control of ‘WBND, ABC 57’ that renders the Sweepstakes not capable of completion as planned, including due to force majeure or non-authorized human intervention that comprises or affects the administration, fairness, integrity, or proper conduct of Sweepstakes, ‘WBND, ABC 57’ may, in its sole and absolute discretion, determine to cancel, terminate, or modify this Sweepstakes, including by determining not to award the planned Prizes or any Prize at all. ‘WBND, ABC 57’ is not responsible for replacing the Prize as a result of events beyond the control of ‘WBND, ABC 57.’

Sponsor shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsor’s control, and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of Event are subject to change. In the event production of American Idol is cancelled or postponed, this prize component may be cancelled without substitution or compensation therefor.  All other prize elements will still be awarded. American Idol tickets have no retail value.  If Winner chooses to attend the Event with no Guest, the remaining elements of Prize shall constitute full satisfaction of Sponsor’s Prize obligation to Winner and no additional compensation will be awarded. All Event participants must be at least 8 years old to attend the taping of American Idol. Guests, if any, may be required to execute and return releases of liability and, where legal, publicity releases (collectively, “Guest Documents”), which must be returned with the Sweepstakes Documents, or Guest portion of the Prize will be forfeited.

This Sweepstakes is void where prohibited, penalized or otherwise restricted by law. Any attempt by any participant to bypass these rules by the use of alias email addresses, illegitimate identities, registrations or logins, or any other scheme will void that participant's entry/entries and may be disqualified from the Sweepstakes. 8. WINNER LIST. The Prize Winner’s name will be posted on www.ABC57.com on May 1, 2018 once the Winner is confirmed according to the Official Rules, their name will be added to this online Winner list. The Winner’s name will be available online until October 1, 2018. If you wish to receive the name of the Sweepstakes Prize Winner, you must send a self-addressed, stamped envelope to ‘WBND, ABC 57,’ ‘American Idol Giveaway Winner,’ 53550 Generations Dr. South Bend, IN 46635. ‘WBND, ABC 57’ must receive any such request for the Winner’s name no later than October 1, 2018.
