“WBND-TV & WNDV-FM Watch and Win: The Kelly Clarkson Show” Sweepstakes
NO PURCHASE NECESSARY. Void where prohibited. By entering, each entrant accepts and agrees to be bound by these Official Rules. Failure to comply with these rules may result in disqualification.
SPONSOR. “WBNBD-TV & WNDV-FM Watch and Win: The Kelly Clarkson Show ” (“Sweepstakes”) is sponsored by WBND-TV (ABC57), and WNDV-FM (U 93) (the “Sponsor”), which is solely responsible for the conduct of this Sweepstakes. For clarity, Universal Television, LLC and The Kelly Clarkson Show (collectively, the “Ticket Provider”) are not sponsors of the Sweepstakes, and are not associated with the administration of the Sweepstakes in any way. Entrants are providing information to Sponsor(s) (as defined below) and not to Ticket Provider.
HOW TO ENTER. No purchase or payment of any kind is necessary to enter or to win this Sweepstakes. The Sweepstakes begins Thursday, April 27, 2023 at 3:00PM (ET) through Thursday, May 25, 2023 at 6:00PM (ET). The last code word revealed on ABC 57 on Wednesday, May 24, 2023. (the “Entry Period”) unless extended by Sponsor. Sponsor reserves the right to extend the Sweepstakes at any time and will provide notice by updating these Official Rules. Entrants may enter this Sweepstakes by watching The Kelly Clarkson Show (the “Program’), weekdays April 27, 2023 through May 24, 2023 on ABC57 at 3:00PM (ET) and look for the code word of the day, revealed in a :30 second spot. The next day or Monday (for any Friday episode), viewers have a chance to call to enter U 93 at 7:00AM, 11:00AM and 2:00PM. (All times ET.) The 9th caller to U93 must provide the previous day’s code word. If correct, that person is entered to win one of four weekly prizes. One winner per week (“Winner”) for a total of four Winners, will be randomly selected from all eligible entries in a particular week each Thursday of that week in the sweepstakes period and announced on U93. All entrants will be required to provide their complete name, phone number, and/or email address or other required information. Sponsor will keep all entrants’ personal information confidential unless disclosure is required by law or in order to provide the prize.
Limit one entry per person, per day, per household address, during the Entry Period. Entrants are permitted to win up to one (1) time during the Entry Period. Duplicate or multiple entries will be disqualified. Use of any automated entry software is prohibited. All entries become the property of Sponsor, and Sponsor reserves the right to use any information submitted by entrants in any media in perpetuity. Sponsor is not responsible for lost, late, illegible, misdirected or mutilated entries, including due to technical/network failures, human error, or any other error or malfunction.
Any attempt to deliberately undermine the operation of the Sweepstakes is a violation of criminal and civil laws, and the Sponsor reserves the rights to seek damages from any person who makes such attempt(s). Entrants also agree not to provide any content which is defamatory, threatening, distasteful, racist, unlawful or otherwise objectionable.
Entry materials that have been tampered with or altered are void. Any questions regarding the number of entries submitted by an individual or authorized account holder of an e-mail address shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes.
ELIGIBILITY. The Sweepstakes is open to all legal residents of the Elkhart/South Bend, IN television viewing area (as defined by A.C. Nielsen) who are 21 years of age or older. Employees and former employees of ABC57, U 93, Weigel Broadcasting, Artistic Media Partners, their advertising agencies, consultants, franchisees, suppliers, and Ticket Provider (collectively, “Sweepstakes Parties”) are not eligible to enter or win, nor are such employees’ family members. In addition, individuals who share a common household with an employee of a Sweepstakes Party or who are in any kind of domestic relationship or partnership with an employee of a Sweepstakes Party (e.g., boyfriends, girlfriends, fiancé, roommates) are not eligible to enter or win this Sweepstakes. By entering this Sweepstakes, entrants agree to abide by all terms of these Official Rules and to be bound by the decisions of the Sponsor. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations, and is void where prohibited or where registration, bonding, or language translation is required.
RANDOM SWEEPSTAKES DRAWING. One Winner will be selected weekly for four consecutive weeks at random from all eligible entries by U 93 on the following Thursdays in May, 2023: May 5; May 12; May 19 and May 25. Odds of winning depend upon the number of eligible entries received. A purchase of Sponsor’s products will not increase the odds of winning. Winners will be contacted each week on May 5, May 12, May 19 and May 25, 2023 by 6:00PM (ET) to be notified that they are a winner. Winners will first be notified by phone call. Winners will need to provide an email address and then, the winners will receive instructions detailing the necessary steps to claim the prize. Winner(s) must meet all eligibility requirements including the execution and delivery of all necessary releases. If any attempted notification is not successful within five (5) days, the prize will be forfeited and Sponsor reserves the right to randomly select an alternate winner from among the remaining eligible entries.
PRIZES. FOUR (4) GRAND PRIZES will be awarded. Grand Prize is: Two (2) tickets for Winner and guest to attend taping of “The Kelly Clarkson Show” (the “Show”) provided by Ticket Provider plus $570 for travel expenses provided by Sponsor, with a total value of $570 USD (the “Prize[s]”). Approximate retail value of all prizes to be awarded is $2,280 USD. Prizes may not be exchanged or redeemed for cash, sold, or traded. Any guest of the Winner must be over the age of 21.
PRIZE RESTRICTIONS & CONDITIONS. Prizes are non-transferable and subject to terms and conditions of the Sweepstakes Parties. There will be no substitute or cash redemption awarded to the Winners. Sponsor and Ticket Provider reserves the right to substitute its prize, in which case a prize of equal or greater value will be awarded. In the event that the Program is cancelled or postponed for any reason, Sponsor and Ticket Provider shall have no further prize obligation to the Winner.
Winner(s) will be solely responsible for any and all local, state, and federal taxes, as well as any license and registration or other fees incurred by participation in the Sweepstakes, including but not limited to transportation costs, gratuities and other items of an incidental nature. Sponsor will report any individual winnings over $600 (in cash or fair market value of goods or services) in a one-year period to the Internal Revenue Service. Winner(s) will receive a Form 1099 from Sponsor if Sponsor reports any winnings to the Internal Revenue Service. Winner(s) and guest, if any, will be required to sign a Program appearance release in order to be part of the Program audience.
Winner(s) must be able to travel [September 2023] through [May 2024] (or on such other dates designated by Sponsors and Ticket Provider), or the Prize will be forfeited. Winner(s) is solely responsible for booking and costs of hotel, airfare, meals and other travel expenses. Winner(s) and guest, if any, must comply with all applicable Show, venue rules and regulations in connection with Prize.
CONDITIONS AND RESTRICTIONS APPLY . Winner(s) must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Proof of U.S. residency, age, and identity are required to claim a prize. Winner(s) is subject to verification by Sponsor, whose decisions are final and binding in all matters related to the Sweepstakes. An entrant is not a winner of any prize unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete. In the event that a winner is determined to be ineligible or fails to respond to Sponsor within five (5) days of notification, the Prize will be forfeited and Sponsor reserves the right to randomly select an alternate winner from among the remaining eligible entries. Sponsor reserves the right to terminate the Sweepstakes without awarding the prizes if no eligible winner(s) or alternate winner(s) claim the prizes within the required time period.
Winners will be required to sign and return an Affidavit of Eligibility, Release of Liability, Publicity Release and Letter of Indemnification and a W9 form within one week of notification of being a winner. In the event that a winner fails to execute and return a liability release and affidavit of eligibility [except where prohibited] within one week, [seven (7) days] of notice of winning, their prize may be forfeited and Sponsor may randomly select an alternate winner from among the remaining eligible entries. If a winner fails to claim their Prize within one week, it will result in the forfeiture of the Prize and a new drawing may be held from the remaining eligible entries at the sole discretion of Sponsor.
By entering, the Winner is consenting to the use of their name, likeness, and/or biographical information for advertising and promotional purposes without additional consideration, including any in-studio appearances, unless prohibited by law. Names and e-mail addresses of Sweepstakes entrants may also be used for future marketing solicitations by Sponsor, unless the entrants opts out of such marketing uses [if applicable].
Sponsor explicitly disclaims any and all warranties of any kind, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Sponsor, Ticket Provider, and/or Sweepstakes Parties shall not be liable or responsible for those guarantees or warranties made or offered by advertisers, partners, manufacturers or suppliers, including those related to the Prize. Under no circumstances shall Sponsor or Ticket Provider be held responsible or liable for use of the information and/or products supplied and/or made available through the promotion or for errors or anomalies resulting in the unintended or erroneous participation, award of any prize or other benefits under the jurisdiction of these sweepstakes rules.
FORCE MAJEURE: The Sweepstake’s Parties reserve the right to change, suspend, or cancel the Sweepstakes or not award prize if, in the Sweepstake’s Parties’ sole discretion, intervening circumstances warrant such change, suspension, or cancellation. Intervening circumstances include, but are not limited to, interruption, preemption, or cancellation of the Sweepstake’s Parties’ business activities owing to conditions beyond its control, such as bankruptcy, route closures, strikes, labor disputes, pandemic, war, insurrection, revolution, terrorism, riot or other civil disturbance, earthquake, fire, flood, or other natural disasters, governmental restrictions, embargoes or other exercises of governmental authority.
LIMITATION ON LIABILITY: By participating in and/or entering this Sweepstakes, each entrant agrees that for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold Harmless Ticket Provider, Sponsor’s and Ticket Provider’s subsidiaries and affiliates and each of such entities’ respective officers, directors, agents and employees (collectively, the “Released Parties”) from any liabity, injury, death, loss, illness, litigation or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Sweepstakes and/or acceptance, possession, use or misuse of the Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Ticket Provider or Sponsor that are sent along with the Prize. In the event that any dispute arises regarding the meaning or interpretation of these Official Rules, entrants agree that the dispute shall be resolved by applying the laws of Indiana and that it shall be resolved by and within the state or federal courts of that state. Further, from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by prize supplier that are sent along with Prize
Sponsor will not be responsible for lost, late, damaged, defaced, incomplete, stolen, illegible, indiscernible, mutilated, illegally obtained, postage due or misdirected entries, or for any typographical or other error in the printing of the offer, administration of the Sweepstakes, or announcement of the prize and/or all Sweepstakes-related materials. Sponsor offers no assurances, warranties, or guarantees that the promotion in any media, including but not limited to on-air, text/mobile phones and websites, will be uninterrupted or error-free and does not promise the accuracy or reliability of any information obtained through this Sweepstakes. Sponsor will not be liable, and is not responsible, for damages of any sort connected to participation in or inability/failure to participate in the Sweepstakes, whether the damages are direct, indirect, special, incidental, or consequential.
SPONSOR’S RESERVATION OF RIGHTS: These Official Rules are subject to modification by Sponsor. In the event of a dispute, all decisions made by Sponsor are final and binding. Sponsor reserves the right, in its sole discretion, to disqualify any person who tampers with or abuses the entry process, or who otherwise acts in violation of these Official Rules. In the event of a computer, telephone failure, or any other circumstances beyond the control of Sponsor, where it becomes impracticable to award one or more Prizes, or due to force majeure or non-authorized human intervention that compromises or affects the administration, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor may, in its sole and absolute discretion, determine not to award any such Prize or cancel, terminate, or modify this Sweepstakes.
PRIVACY POLICY/DISCLOSURES OF INFORMATION. Sponsor may collect and use personal information that entrants provide to enter the Sweepstakes to actually conduct the Sweepstakes and contact the potential winner(s). Personal information includes any information that can be reasonably linked to a specific individual, including name, postal address, and telephone number. Sponsor (including any successors or assigns) may use names and e-mail addresses of Sweepstakes entrants for future marketing solicitations by Sponsor, unless the entrant opts out of such marketing uses. Otherwise, no personal information that Sponsor collects in connection with the administration of the Sweepstakes will be sold or given to anyone who may contact entrants for any purpose not related to the sweepstakes [if applicable]. If a Prize winner chooses to submit a photo to the ABC57 or U 93 staff, they do so understanding that photos may be used at the sole discretion of the ABC57 or U 93 teams – including on-air, online and social media promotional purposes.
